Due to the complexities in bonding steel belts to rubber, tread separations are a tragic consequence of modern steel-belted radials. A tread separation occurs when the steel belts actually separate from the tire, resulting in the tire tread peeling off of the tire. Tread separations are caused by poor design or manufacture of the tire. A well designed tire is unlikely to experience a tread separation. Implementation of nylon cap-plies, anti-oxidant chemicals and a thick belt wedge are all components some tire manufacturers use to prevent tires from separating. Unfortunately, in an attempt to save money, some tire companies skimp on these components resulting in a higher incidence of tread separations.
Consumers who have experienced a tread separation may have a products liability case against the tire manufacturer for the tread separation. A tread separation lawyer must have the resources to determine if the accident was caused because of the tread separating, and if the tire manufacturer may be at fault. A tread separation lawsuit can be very expensive to pursue, typically costing between $300,000 to $600,000 in costs. Consumers should seek and consider the advice of their tread separation attorney before making any decisions regarding a lawsuit against the tire manufacturer.
There are a few things that consumers can do to help prevent such an accident. Tires should be checked periodically for physical damage to the tread and sidewall. Consumers should also check the age of their tires. Older tires deteriorate and unknown to the consumers, become at risk for a tread separation in as few as three to four years.
