Jacqueline Lum of Honolulu, Hawaii received a DePuy ASR Acetabular hip replacement system implant in August, 2009. Only 15 months later, Lum suffered constant pain from the defective device as it ground together and deposited toxic metal fragments into her bloodstream, a Hawaii News Now article reports. Lum was scheduled to undergo revision surgery on November 8, 2010.
Lum explains, “I stand up, sit up from the chair, it hurts, I sleep at night I need to take medication so that I can help take the pain away,” KHON News reported. Lum has filed a lawsuit against DePuy and joined thousands of other patients who have experienced similar problems with the hip implants. In addition to excruciating pain, Lum’s doctors have also found that the cobalt and chromium levels in her blood are much higher than normal.
DePuy issued a recall of the hip replacement devices in August of this year. Both before and after the recall, DePuy has faced a steadily increasing number of lawsuits. Nearly all of the plaintiffs allege that DePuy has known for years that the recalled devices were faulty, yet the company did nothing to warn doctors or patients of the high potential for failure.
A Honolulu Star Advertiser article reports that Lum’s attorney “said DePuy knew there was a problem with its hip implants well before it received data from the British registry in April. Officials from the Australian National Joint Replacement Registry reported problems with the devices as early as 2007.”
Lum’s lawsuit was filed in federal court near the end of last month. Although there is no sign yet of mass settlements being reached, we will continue to cover the DePuy hip replacement legal news as details emerge.
