Levaquin Class Action Lawasuit Growing Over Accusations of Tendon Damage

Levaquin, an antibiotic that has been typically prescribed to put a halt to the reproduction of bacteria, has come under fire in recent years due to claims that the drug allegedly damages tendons. Several hundred lawsuits have already been filed against Johnson & Johnson because of Levaquin, with one of the most recent cases being filed by a woman in Texas due to the tendon problems she has experienced after taking the antibiotic.

Lisa Presley, in a case filed against Johnson & Johnson and its subsidiary Ortho-McNeil Pharmaceuticals on April 8 as a class action lawsuit, states she now has permanent and severe injuries from the development of Achilles tendonitis that has occurred as a result of her use of the drug Levaquin. She has filed a number of charges against the defendants and has sited multiple damages for which she is seeking compensation. The class action lawsuit was filed to let others who may be experiencing the same effects seek compensation for their medical bills and other expenses as well. The charges filed against the defendants include but are not limited to:

– Violation of consumer protection laws
– Negligence
– Fraud
– Strict product liability
– Breach of warranties
– Failure to warn

The damages that Presley is seeking are for medical expenses, economic losses, physical impairment, disability, mental anguish, disfigurement, suffering, and pain.

Although the FDA was petitioned by the group Public Citizen in 2006 to provide strong warnings to consumers about the drug, it wasn’t until 2008 that a black box warning was required by the FDA to appear on the drug’s packaging, providing information about potential damage to tendons. This warning has been added to not only Levaquin but also other similar antibiotics that fall into the group of medications known as fluoroquinolones.

While hundreds of tendon rupture lawsuits regarding the use of Levaquin have been filed throughout the United States, they have all been combined into a multi-district litigation taking place in Minnesota at the U.S. District Court. More than 100 similar cases have also been filed across the country alleging the makers of this antibiotic did not properly warn users about the possible side effects of the drug. The first six Levaquin lawsuits that are going to trial in Minnesota have been deemed “bellwether” trials that will gauge how the jury will respond to the testimony and evidence involved in the cases.
